These terms are the agreement between you and Kluniverse LLC for using Tanq. By downloading or using the app, you agree to them.

The agreement
These Terms of Use ("Terms") cover the Tanq app for iPhone and any related services (together, "Tanq"), made by Kluniverse LLC ("Kluniverse," "we," "us"). Our Privacy Policy explains how we handle your information and is part of these Terms. If you don't agree, please don't use Tanq.
Your account
Some features, like sync, need an account. Keep your sign-in secure and tell us if you think someone else is using it. You're responsible for what happens under your account.
Your content
Your notes, recordings, and everything else you put in Tanq belong to you. You give us a limited permission to store, process, and transmit your content only as needed to run Tanq for you, including sending it to our AI provider when you use a cloud feature. This permission ends when you delete the content or your account, except for copies in backups that roll off on their normal schedule.
You're responsible for your content and for having the right to capture it. If you record other people, follow the laws where you are about recording conversations.
AI features
Tanq uses AI to transcribe, rewrite, brainstorm, research, and talk with you about your notes. AI can be wrong, incomplete, or out of date, and it can sound sure when it isn't. Check anything important before you rely on it, and don't use Tanq as a substitute for medical, legal, financial, or other professional advice. You're responsible for how you use what Tanq suggests.
To keep things fair, cloud AI features may have usage limits, which can vary by plan and may change.
Using Tanq responsibly
Please don't:
- break the law or violate anyone else's rights using Tanq
- try to get into systems or accounts that aren't yours, or interfere with how Tanq works
- copy, reverse engineer, or resell Tanq, except where the law allows it
- use Tanq to create content that is harmful, abusive, or exploits children
- use automated tools to overload our service or pull out Tanq's instructions or models
We may suspend or end access for anyone who does.
Paid plans
Some features may require a paid subscription, bought through Apple. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple ID is charged at confirmation and at each renewal. You can manage or cancel in your Apple ID settings. Refunds are handled by Apple under its policies. If we change prices, we'll tell you ahead of time, and you can cancel before the new price applies.
Beta versions
If you use a test version of Tanq, such as through TestFlight, it may have bugs, lose data, or change without notice. Keep a copy of anything you can't afford to lose. Feedback you send us can be used to improve Tanq without any obligation to you.
Other services
Tanq can work with services we don't control, such as Apple, iCloud Drive, Google Drive, GitHub, your calendar or email, smart glasses, and AI providers. Your use of those services is covered by their own terms, and we're not responsible for them.
Our rights in Tanq
Tanq, including its design, code, personality, and the Tanq name and logo, belongs to Kluniverse. We give you a personal, non-transferable license to use the app on Apple devices you own or control, under these Terms and Apple's Usage Rules. Nothing here gives you rights to our trademarks.
Ending your use
You can stop using Tanq and delete your account at any time. We may suspend or end your access if you break these Terms, if the law requires it, or if we stop offering Tanq. If we shut Tanq down, we'll give you reasonable notice and a way to export your notes. Sections that by their nature should continue, like ownership, disclaimers, and limits on liability, still apply after your use ends.
Disclaimers
Tanq is provided "as is" and "as available." To the fullest extent the law allows, we don't promise that it will be uninterrupted, error free, or that it will never lose data, and we disclaim all implied warranties, including fitness for a particular purpose and non-infringement.
Limits on our liability
To the fullest extent the law allows, Kluniverse is not liable for indirect, incidental, special, or consequential damages, or for lost data, profits, or goodwill. Our total liability for any claim about Tanq is limited to the greater of what you paid us for Tanq in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not all apply to you.
Indemnity
If your content or your breaking these Terms leads to a claim against us, you agree to cover our reasonable costs, including legal fees, to the extent the law allows.
Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law rules. If a dispute comes up, please contact us first so we can try to sort it out. If we can't, it will be decided in the state or federal courts in Cook County, Illinois, unless the law where you live gives you the right to bring a claim locally.
Apple App Store terms
If you got Tanq from the Apple App Store:
- These Terms are between you and Kluniverse, not Apple. Apple is not responsible for Tanq or its content.
- Apple has no obligation to provide maintenance or support for Tanq.
- If Tanq fails to meet any warranty that applies, you can notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for Tanq.
- Apple is not responsible for any claims about Tanq, including product liability claims, claims that Tanq fails to meet legal or regulatory requirements, or consumer protection claims.
- If someone claims Tanq infringes their intellectual property, Kluniverse, not Apple, is responsible for dealing with it.
- You confirm you are not in a country under a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms as Tanq changes. For meaningful changes, we'll update the effective date and let you know in the app before they take effect. Using Tanq after that means you accept the new Terms.
General
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given up the right to later. You can't transfer these Terms without our consent; we can transfer them as part of a sale or merger. These Terms and the Privacy Policy are the whole agreement between us about Tanq.
